                     JUDGMENT

1. By means of this writ petition, petitioner has sought following reliefs:-

(a) Issue a writ, order and direction in the nature of certiorari quashing the impugned order dated 10.09.2021 passed by learned Incharge District Judge, Dehradun/1st Additional District Judge, Dehradun, in Rent Control Appeal No. 8 of 2021 - Deepak Bansal & another vs. Sharad Kumar Gupta & other, to the extent of granting unconditional stay order in favour of respondent nos. 1 & 2 till disposal of Rent Control Appeal No. 8 of 2021 and issuing notices to Performa Respondents Nos. 2 to 6 in the appeal (Annexure No. 1 to this writ petition).

(b) Issue a writ, order or direction directing Court of learned 1st Additional District Judge, Rishikesh, to decide in accordance with law Rent Control Appeal No. 8 of 2021

- Deepak Bansal & Another vs. Sharad Kumar Gupta & others, within the stipulated period prescribed under Rule 7(7) of Uttar Pradesh Urban Buildings (Regulation of Letting Rent & Eviction) Rules, 1972.

2. After arguing for a while, Mr. Neeraj Garg, learned counsel appearing for the petitioner submitted that he is giving up the challenge thrown to the order dated 10.09.2021 and he confines his prayer only to the extent of prayer no. (b). He further submits that Appellate Court be directed to decide Rent Control Appeal No. 8 of 2021 within some stipulated time frame.

3. Having regard to the facts of the case, the writ petition is disposed of with a request to learned Appellate Court to expedite hearing of Rent Control Appeal No. 8 of 2021. Unnecessary adjournment to the parties shall be avoided.
