Mr. Mahendra Singh Rawat, Advocate for the petitioners.

Petitioners claim that initially they were appointed on contract basis and when not regularized and not paid equal pay for equal work, they had to file a writ petition, which was decided in their favour on 27.07.2020 by this Court by a judgment and order passed in WPSS No.2728 of 2017 and other connected matters. According to the petitioners now the Dearness Allowance has been reduced. In that matter, it is second round of litigation.

Mr. P.S. Bisht, Additional Chief Standing Counsel takes notice on behalf of respondent nos.1, 2 and 5.

Mr. Ashish Joshi, Advocate takes notice on behalf of respondent nos.3 and 4.

Counter affidavit may be filed within four weeks.

Stay Application (IA) No.1 of 2021 Heard on stay application.

By means of the stay application, petitioners seek that the operation of the impugned orders, by which, the payment of Dearness Allowance has been stopped be stayed.

In any eventuality in case, the petitioners succeed, they would claim the arrears. Considering this and other relevant facts, this Court is of the view that at this stage there is no reason to grant interim order. Hence, stay application is rejected.
