This criminal revision has been filed against the judgment dated 29.09.2021, passed by the learned First Additional Sessions Judge, Rishikesh, District Dehradun in Criminal Appeal No.49 of 2020, "Smt. Meenakshi Naithani vs. State of Uttarakhand and Others", whereby the appeal, filed by the respondent no.2, is allowed and the revisionist no.1 is directed to pay Rs.7,000/- per month as maintenance amount and Rs.5,000/- per month as residence expenses to the respondent no.2. The revisionist no.1 is further directed to pay Rs.25,000/- as medical expenses to the respondent no.2, wife of the revisionist.

Heard Mr. T.P.S. Takuli, learned counsel for the revisionists and Mr. V.S. Rathore, the learned Assistant Government Advocate assisted by Mr. Sachin Panwar, the learned Brief Holder for the State.

The learned counsel for the revisionists submitted that income of the revisionist is Rs.66,000/- per annum only. The learned counsel for the revisionists further submitted that an undertaking has been given by the revisionist no.1 that he (revisionist no.1) would pay the amount @ Rs.5,000/- from the date of passing of the appellate order i.e. 29.09.2021 to the respondent no.2 within 20 days from today. The learned counsel for the revisionists further submitted that the revisionist no.1 also undertakes that he will pay the entire medical expenses, as directed by the learned appellate court, within two months from today to the respondent no.2.

In view of the above undertakings, the operation and effect of the impugned judgment dated 29.09.2021 is stayed till the next date of listing.

Stay Application (IA) No.01 of 2021 is disposed of accordingly.

Issue notice to respondent no.2. Steps to be taken within one week. Post on 29.12.2021.
