Heard Mr. Ramji Shrivastava, learned counsel for the applicants, Mr. Pratiroop Pandey, learned A.G.A. for the State and Mr. Piyush Garg, learned counsel for the private respondent no.2.

During the arguments, learned counsel for both the parties are in agreement that that applicant nos.5 and 6, namely, Raj Kumar Agarwal and Harish Arora have vacated the premise in-question and the applicant no.7 was not party before the Magistrate. The learned counsel for the applicants submitted that the applicant nos.1/1 to 1/3 and the applicant nos.2 to 4 are contesting this application, filed under Section 482 of Code of Criminal Procedure, 1973.

During the arguments, the learned counsel for the applicants submitted that the applicants were not tenant in the vacant rooms, as shown in the sale deed.
