The grievance of the petitioner, who is a plaintiff in a suit for grant of decree of permanent injunction, is as against the impugned judgment and order dated 26.02.2021, which has been passed by the Revisional Court in a Civil Revision No.148 of 2019, "Sri Mathura Prasad Vs. Sri Pratap Yadav and others", which has been allowed and as a consequence thereto, the defendant's application under Order 7 Rule 11 of the CPC has been allowed, which earlier stood rejected by the court of Civil Judge (J.D.) Doiwala, District Dehradun in O.S. No.17 of 2019, "Pratap Yadav Vs. Sri Mathura Prasad and others".
Issue notice to the respondent nos.2, 3 and
4. Steps to be taken within a period of ten days.
Let counter affidavit be filed within a period of three weeks, after service of notice.
Till the next date of listing, the operation and effect of the impugned order dated 26.02.2021 would kept in abeyance.
