This criminal revision, preferred by the revisionist u/s 397/401 of Code of Criminal Procedure, 1973 (hereinafter to be referred as Cr.P.C.), is directed against the judgment and order dated 15.09.2016 passed by learned Judge Family Court, Udham Singh Nagar, in Misc. Criminal Case No.49 of 2014, 'Smt. Geeta Tiwari vs. Girish Chandra Tiwari', whereby the learned Judge Family Court allowed the application filed under Section 127 of Cr.P.C.
Learned counsel for both the parties submitted that divorce has taken place between the parties finally. As regard to the arrears of maintenance allowance is concerned the revisionist is ready to pay the same within a period of one month to the respondent.
Accordingly, the present revision is dismissed as infructuous. The revisionist is directed to pay the arrears of maintenance before the Juge Family Court, Udham Singh Nagar within a period of one month.
Pending application, if any, stands disposed of.
