CRLR No.29 of 2021
Hon'ble R.C. Khulbe, J.
Mr. Jitendra Chaudhary, learned counsel for the revisionist.
Mr. Pramod Tiwari, learned B.H. for the State.
Notice issued to respondent no.2 has been served personally, however, none is present on his behalf.
In view of the grounds stated, delay in filing the revision is condoned. Delay condonation application (IA 1/21) stands disposed of.
Heard.
This criminal revision is directed against the judgment and order dated 17.11.2017 passed by the J.M. Rishikesh in Crl. Case No.1099 of 2012, and judgment and order dated 19.02.2020 passed by the Second Addl. Sessions Judge, Rishikesh (Dehradun) in Crl. Appeal No.159/17.
Admit.
Summon the LCR.
List thereafter.
Also heard on the bail application (IA 2/21). It is argued that the revisionist was on bail during trial and he never misused the said liberty.
The State counsel has no serious objection to the same.
Looking to the facts and circumstances of the case, the revisionist is enlarged on bail on his executing a personal bond and furnishing two sureties, each of the like amount, to the satisfaction of the Court concerned.
The revisionist, however, shall deposit the fine as imposed by the Trial Court against him, if not already done.
Bail application is allowed accordingly.
