This is an SCC Revision, preferred by the revisionists-tenants/judgment debtor, challenging the judgment and decree dated 06.02.2021, which has been passed by the Judge, Small Causes Court / 4th Addl. District Judge, Dehradun, in SCC Suit No. 38 of 2012, N.K. Sarin Vs. Smt. Anjana Khanna and others, whereby the Suit of the plaintiffs/ respondents had been decreed.
Being a regular Civil Revision under Section 25 of the Provincial Small Cause Courts Act, the Revision is admitted.
Summon the Lower Court's record. No notices are required to be sent, as the respondents have already put in appearance through Caveator / Counsel.
The respondents may file their objection to the Stay Application No. 1 of 2021.
In the meantime, the execution of the impugned judgment and decree dated 6th February, 2021, would be kept in abeyance till the next date of listing, subject to the condition that the revisionists deposit the entire decreetal amount before the learned Judge, Small Causes Court, within a period of four weeks from today, after adjusting the amount, if any, already deposited by the revisionists and further continue to remit the rent @ Rs.1,000/- p.m..
