The Court made the following:
JUDGMENT: (per Hon'ble The Chief Justice Sri Raghvendra Singh Chauhan)
The learned counsel for the appellant
wishes to withdraw the present appeal and seeks
liberty to file a fresh revision petition before the State
Government, under Section 11(2) of the Uttarakhand
Excise Act, 1910. The learned counsel further submits
that the appellant is already hit by the limitation,
therefore, he may face some consequences in
submitting the revision petition.
2. Accordingly, the present appeal is
dismissed as withdrawn, the liberty to file a revision
petition is hereby, granted. The State Government is
requested to consider the case sympathetically, on
the issue of the limitation, as the appellant had
approached the wrong forum.
