This petition was already decided by me by an earlier judgment and thereby certain directions were issued to the court of Additional Chief Judicial Magistrate, to decide the proceedings as per the directions contained in the judgment of 07.08.2020.
This matter is listed on a Misc Application No.1203 of 2021, whereby Registry has taken cognizance to the Administrative letter, which was written by the Additional Chief Judicial Magistrate, seeking an extension of time to comply with the directions which were given in the order of 07.08.2020. When the aforesaid letter was taken up on the previous occasions, the counsel for the respondents had made a statement the proceedings of the aforesaid case has now been transferred to the court of Judicial Magistrate, Haldwani, by an order of 19.03.2021. Hence, in view of the said fact that the proceedings now since has been stands transferred to the Judicial Magistrate, Haldwani by an order of 19.03.2021, as on the basis of order passed in a Transfer Application, the application submitted by the Additional Chief Judicial Magistrate on administrative side becomes irrelevant hence, the same is rejected.
