Judgement Date : 25 June, 2021
IN THE HIGH COURT OF UTTARAKHAND
AT NAINITAL
ON THE 25th DAY OF JUNE, 2021
BEFORE:
HON'BLE SHRI JUSTICE MANOJ KUMAR TIWARI
Writ Petition (M/S) No.1906 of 2018
BETWEEN:
Rajkumar .....Petitioner
(None present)
AND:
Union of India & Others .....Respondents
(Mr. T.S. Phartiyal, Addl. C.S.C. for the State of
Uttarakhand/respondent no.3)
JUDGMENT
There is no representation for the petitioner as well as for Union of India/respondent nos.1 and 2. Heard Mr. T.S. Phartiyal, Addl. C.S.C. appearing for the State of Uttarakhand/respondent no.3 through video conferencing.
2. Petitioner was granted parking rights by Senior Divisional Commercial Manager, Northern Railway, Moradabad, as his bid was found to be the highest. An allotment letter was issued to him on 04.04.2018, whereby he was asked to furnish 2% of the tender amount towards registration fee. Feeling aggrieved by the condition of deposit of 2% of the tender amount, petitioner filed this writ
petition in the month of July, 2018. No interim order was passed in favour of the petitioner.
3. A perusal of the allotment letter dated 4.4.2018 reveals that parking rights were granted to the petitioner for a period of 3 years. The period of 3 years, for which contract was awarded to the petitioner, is over now. In such view of the matter, the relief as claimed in the writ petition cannot be granted at such a late stage.
4. Accordingly, writ petition is dismissed. No order as to costs.
(MANOJ KUMAR TIWARI, J.) Rajni
