The brief facts which are involved in the present writ petition are that the petitioner has come up with a case that his late father, who was working as a regular Class IVth employee in the District Hospital, District Pauri Garhwal, has met with the sad demise, during the period of his services on 08.11.2011.

The petitioner contends that immediately after the death of his father, since he was residing along with the mother and separate from his elder brother, who is residing independently, he had applied for the grant of an appointment on compassionate grounds by filing an appropriate application to the said effect on 12.12.2011. Further in support of his contentions, the petitioner contends that the District Magistrate, Pauri Garhwal, after processing his application, has informed the respondent No.2, about the credentials of the petitioner, and the source of earning, which the family is having, whether they would be able to sustain themselves after the death of the breadwinner.

Without expressing any opinion on the merits of the matter, since the issue was already recommended by the District Magistrate, to be considered by the respondents, coupled with the fact that the petitioner has already raised a claim by way of filing a representation on 07.07.2021.

Without expressing any opinion on the merits of the matter, this writ petition is being disposed of with a request to the respondent No.2, to take a decision on the representation of the petitioner within a period of two months from the date of the production of the certified copy of this judgment.

Subject to the above observations, the writ petition stands disposed of.
