The present writ petition arises out of the concurrent judgments which has been rendered in the proceedings under Section 122-B of the U.P.Z.A. & L.R. Act, and as a consequence thereto, while holding the petitioner to be encroacher on a gram sabha land by raising a residential construction, the damages have been levied to be paid by him to the tune of Rs. 4,22,000/-.
The respondent Nos. 1 to 3, who are represented by the learned Standing Counsel and respondent No. 4, who is represented by Mrs. Anjali Bhargava, Advocate, they pray for and are granted four weeks' time to file their counter affidavits.
However, the eviction in pursuance to the impugned orders would be kept in abeyance till next date of listing, subject to the condition that petitioner deposits the penalty imposed to the tune of Rs. 4,22,000/-, before the Registry of this Court within a period of six weeks from today.
List this writ petition after filing of the counter affidavit.
Stay Application No. 1/2021 stands disposed of accordingly.
