(Via video conferencing).

Mr. Shubhang Dobhal, Advocate, for the petitioners.

Mr. N.P. Shah, Standing Counsel, for the State of Uttarakhand.

Mr. Ravi Babulkar, Advocate, for the respondent.

The petitioners to the present writ petitions, have come up with a case that they are working with the respondent Municipal Board as Sweepers, but they have been deprived of their regular pay and salary, which they otherwise, according to them are entitled to receive, on the ground that they are discharging the similar nature of services, as that of a regular employee. Hence, they contended that they would be entitled for a parity of wages, as well as the minimum of pay scale, which is to be paid to them, and hence they had preferred these writ petitions for the following reliefs:-

"I. Issue a writ, order or direction in the nature of mandamus commanding the respondents to consider the case of the petitioners for the payment of minimum of pay scale (Rs.5200-20200) with grade pay Rs.1800 to the petitioners as being paid to the regular employee working on the post of sweeper on the principle of equal pay for equal work."

When, these writ petitions, were taken up initially, these writ petitions were admitted by the Coordinate Bench of this Court vide its order dated 17.07.2019.

Today, when the matter was taken up, the learned counsel for the petitioners had confined his relief to the extent that an appropriate direction may be issued to the respondent no.2, to consider and decide the respective representations of the petitioners, so far it relates to the relief claimed in the writ petitions, as it has been submitted by them on 02.05.2019 or otherwise.

With the consent of the counsel for the parties. These writ petitions are being disposed of with a liberty left open to the petitioners to file their individual fresh representations before the respondent No.2, within a period of three weeks' from the date of the receipt of the certified copy of this judgment. The respondent No.2, is directed to take a decision on the representations of the petitioners thus to be filed, itself for the relief claimed in it, within a period of two months thereafter.

Subject to the above observations, the writ petitions stand disposed of.
