List revised. The earlier counsel, who has preferred this Contempt Petition had now been appointed as Standing Counsel, hence, he cannot appear on behalf of the petitioner. Mr. J.S. Bisht, Standing Counsel for the State is present for the State of Uttarakhand.
Even otherwise, since being a Contempt Petition, it cannot be dismissed for want of prosecution, hence, it is being proceeded to be decided on its own merit.
The petitioner of the Contempt Petition, had sought an enforcement of the judgment dated 13th January, 2017, which was passed by this Court in Writ Petition No. 2334 of 2016 (M/S), M/s Tomar Detective Security Pvt. Ltd. Vs. State of Uttarakhand and others, whereby by the judgment rendered by this Court, the direction was issued to the respondent to take a decision on the representation of the petitioner, which was filed by him on 19th July, 2016.
Alleging its non compliance, the Contempt Petition was filed on 18th May, 2017. Notices were issued to the respondent and the respondent in response and compliance thereto, had filed a response affidavit on 12.06.2017, and in the response affidavit thus filed by the respondent, he had placed on record the order of 1st March, 2017, whereby it is shown that the respondent had taken a decision on the representation, which was submitted by the petitioner.
In view of the said decision, which has been placed on record with the compliance affidavit, the Contempt Petition is closed. Notices issued to the respondent are hereby discharged.
