In this bunch of Writ Petitions, the candidates, who had qualified their NEET examination, have been granted admission as against the respective BAMS course conducted by the petitioners of the Writ Petitions for the academic year 2019-20.

When the matter travelled to this Court, the Coordinate Bench of this Court after taking into consideration the various judgments rendered by the other High Courts, i.e. Karnataka High Court, High Court of Judicature at Allahabad and Rajasthan High Court, had granted the interim protection and the students were permitted to be admitted by the petitioners to pursue their course, subject to the rider that they ought to have been the students, who are otherwise qualified, as per the NEET examination and norms laid by the respondents.

In pursuance to it, it is the case of the petitioners that the students have been admitted against the vacant seats which were respectively available for the said academic year and the examination schedule has been notified to be commenced from 27th January, 2021, but the students thus admitted as a consequence of the interim order, are being restrained and deprived to take their respective examination on account of the absence of approval being granted by the respondents.

Hence, the Registrar of Uttarakhand Ayurvedic University, is hereby directed by way of interim measure to provisionally, enroll the aforesaid students and permit them to take their examination provisionally. However, their appearance in the examination would be subject to the final decision to be rendered in the Writ Petitions.
