Instant writ is filed seeking regularization of the services of the petitioner.

On 07.07.2017 an interim order was passed directing the respondents to pay the petitioner minimum of pay scale in terms of the judgment of the Supreme Court in the case of State of Punjab & Others vs. Jagjit Singh & others in Civil Appeal No. 213 of 2013. It appears that respondents did not comply with the interim order and a contempt petition was filed by the petitioner, which was dismissed by this court on 02.12.2020 on various grounds.

Now, a Misc. Application No. 17200 of 2021 is filed seeking directions that the necessary order relating to grant of minimum pay scale to the petitioner be passed. This Court has already passed interim order on 07.07.2017, which is still in force.There is no need to pass any other order. Therefore, the Misc. Application is disposed of accordingly.

Learned counsel for respondent no.3 would submit that the petitioner is being paid the wages of daily labourer, on which, he is working and thereby the interim order dated 07.07.2017 is being complied with by the respondent no.3.

Learned counsel for the petitioner would submit that minimum wages is not being paid to the petitioner as directed on 07.07.2017.

Pleadings have already been exchanged. List this case after two weeks for final hearing.

Meanwhile, respondent no.3 shall file an affidavit categorically stating as to how interim order dated 07.07.2017 is being complied with.
