This Civil Revision has been filed under Section 25 of the Provincial Small Cause Courts Act, 1887 against the judgment and decree dated 18.11.2021, passed by the learned Judge, Small Cause Court/District Judge Almora in SCC Suit No.9 of 2019, "Kamla Bisht vs. Nandan Singh Rawat", whereby the said suit was allowed.

Heard Mr. Siddhartha Singh, learned counsel for the revisionist.

Mr. Siddhartha Singh, the learned counsel for the revisionist, submitted that while hearing the suit, point for determination was not framed, which was necessary to decide the case. In support of his submissions, the learned counsel for the revisionist has relied upon a judgment of Hon'ble Supreme Court in Rameshwar Dayal vs. Banda (Dead) Through His LRS. and Another (1993) 1 SCC 531.

This Civil Revision is admitted. Issue notice to the respondent. Steps to be taken within a week. Post this case on 17.02.2022. The effect and operation of the impugned judgment and decree dated 18.11.2021, passed by the learned Judge, Small Cause Court/District Judge, Almora in SCC Suit No.9 of 2019 "Kamla Bisht vs. Nandan Singh Rawat", is stayed till the next date of listing. Stay Application (IA No.1 of 2021) stands disposed of accordingly.
