Mr. H.C. Pande, Advocate for the appellant. Instant appeal is preferred against the judgment and award dated 22.01.2021, passed in Motor Accident Claim No.288 of 2017, Smt. Swarn Kaur and others vs. Devendra Pal Singh and another, by the Motor Accident Claims Tribunal/Additional District Judge, Khatima, District Udham Singh Nagar.

Issue notices to the respondents. Summon the LCR.

Heard on Stay Application (IA) No.1 of 2021. Learned counsel for the appellant would submit that it is a case filed under collusion; the vehicle which according to the claimants hits the deceased has falsely been planted to get the insurance; FIR was lodged after 27 days; there is no medical prescriptions which may reveal that the death was by accident, even the postmortem does not reveal that it was a case of road accident.

Be it as it may, this Court does not see any reason to stay the operation of the judgment and award. Appellant shall deposit the amount, which shall be invested in a recurring term deposit in some nationalized bank. The amount shall not be released without prior permission of this Court.
