When the case is called out, both sides are present.
Heard at length.
During the course of argument, Mr. Somik Deb, learned senior counsel appearing for Kumarghat Municipal Council submits that the Agartala Municipal Corporation has preferred SLP in a batch of writ appeals in the identically placed situation and also the cases have been taken on record and further in the order dated 16.01.2026 passed in SLP (Civil) Diary No(s).39906 of 2025, contempt proceedings were stayed by the Hon'ble Supreme Court. Mr. Deb, learned senior counsel while referring to the batch of writ appeals filed by the Agartala Municipal Corporation before the Hon'ble Supreme Court insists that since the subject matter involved in the present case is pending before the Hon'ble Apex Court and interim orders are also granted by the Hon'ble Supreme Court, appropriate decision be taken by this Court.
Mr. Roy Barman, learned senior counsel appearing for the writ petitioner submits before this Court that a Coordinate Bench in WA No.161 of 2022 along with other connected writ appeals in identically placed situation has passed the order in favour of the employees making applicable the Gratuity Act which is more
beneficial legislation and prays to follow the same while passing the order or in alternative, if different opinion is taken, the matter be referred to a larger bench.
Upon hearing the submissions made by both sides, this Court is of the opinion that since the subject matter involving a batch of writ appeals is sub-judice before the Hon'ble Supreme Court, this Court feels that this matter needs to be awaited till the Hon'ble Supreme Court decides the case. Thus, this matter stands adjourned sine die.
However, both the parties are at liberty to move before the Registry once the batch of writ appeals are decided by the Hon'ble Apex Court.
