16/01/2026 Heard counsel for the petitioner.
This I.A.No.01 of 2025 in Review Pet. No.30 of 2025 is filed
under Section 5 of Limitation Act, 1963 to condone delay of 457 days in
filing the Review Petition.
It is not in dispute that the petitioner herein had filed
WP(C)No.426 of 2021 which had been disposed of by a judgment dt.
20.02.2023 partially granting relief to the petitioner.
Challenging the said judgment, the State had preferred Writ
Appeal No.53 of 2023. The petitioner had also filed Writ Appeal No.30 of
2023 to the extent that the Learned Single Judge had denied relief to him.
Both the Writ Appeal No.30 of 2023 and Writ Appeal No.53 of
2023 had been disposed of by a common order on 02.07.2024.
Seeking review of the judgment in W.A. No.30 of 2023,
petitioner filed Review Pet. No.35 of 2024 within time. When the same was
taken up, it was pointed out by this Court to. the counsel for the petitioner
that a single Review Petition is not maintainable to modify a common order
passed in two Writ Appeals.
Therefore, the petitioner has filed I.A.No.01 of 2025 along with
a Review Pet. No.30 of 2025 to review the order in Writ Appeal No.53 of
2023 as well.
Since both the Review Petitions arise out of the same judgment
of the Division Bench, we deem it appropriate to condone the delay of 457
days in filing this Review Petition, since obviously on account of lack of
knowledge initially the petitioner had not preferred two Review Petitions.
Therefore, I.A.No.01 of 2025 is allowed and the delay in filing
the Review Petition is condoned.
List the matter on 13.02.2026 along with Review Pet.No.35 of
2024.
