It is seen from record that in pursuance to order of this Court dated 25.11.2025, steps were taken by the petitioner for service of notice upon the respondent by way of substitute service of notice through newspaper publication in the newspapers namely 'Tripura Times' the widely circulated English Daily in Tripura and the vernacular newspaper 'Hindustan Times' in the State of Bihar and an acknowledgment regarding said paper publication of notice, has also been placed on record. Since the said widely circulated English news papers have been published indicating the notice upon the respondents, it may be treated that the notice upon the said respondent is served.

When the case is called, Mr. Raju Datta, learned P.P. appears on behalf of the petitioner State. But, despite service of notice through substitute mode, there is no representation on behalf of the said respondents.

This present petition has been filed for granting special leave to appeal against the judgment/order dated 15.12.2023 passed by the learned Sessions Judge, Gomati District, Udaipur in case No.ST (T-1) 35 of 2022 whereby the respondent- accused person was acquitted from the charge under Section 302 of IPC.

Having heard the submissions made on behalf of the petitioner and after

going through the averments made in the application, this Court is of the view that

the matter requires further examination. Accordingly, the present criminal leave

petition is hereby granted and the same stands disposed of.
