Heard Mr. Dhruba Jyoti Saha, learned counsel led by Mr. Bibhal Nandi Majumder, learned senior counsel appearing for the petitioner.

Mr. Saha, learned counsel submits that the petitioner was a Group-D employee who went on retirement on 31.01.2018. Thereafter, the State Bank of India suddenly started recovering certain amounts and in a single instance deducted Rs.5,50,000/-. Thereafter, the petitioner approached this Court by referring a writ petition bearing WP(C) No.678 of 2023, which was disposed of by a co-ordinate Bench of this Court on 02.02.2024 directing the bank to refund the said amount to the petitioner immediately along with costs of Rs.25,000/-. Liberty was given to the bank authority to provide the petitioner with a statement of account and all particulars in case it further feels to go for any such recovery on account of excess withdrawal, and in such case, they would also issue show-cause notice and call for his explanation and then would take steps for recovery of the said amount.

Mr. Saha, learned counsel refers to a letter dated 13.05.2024 addressed to the petitioner by the bank authority intimating him regarding refund of said Rs.5,50,000/- along with cost. However, simultaneously they

also informed the petitioner that his pending recovery of Rs.6,88,560/- was being recovered on monthly basis @ Rs.4,641/- from his pension. The grievance of the petitioner, according to Mr. Saha, learned counsel is that continuously the bank is recovering an amount of Rs.4,641/- or above on monthly basis from his pension and even on one occasion they also recovered Rs.1,77,000/- and on three occasions they deducted more than Rs.6,341/- without issuing any show-cause notice etc. With such grievances, the present writ petition has been filed.

Mr. Dipankar Sarma, learned Addl. G.A. appears and accepts notice for respondents No.1 & 2.

Mr. Debalay Bhattacharya, learned senior counsel appears and accepts notice for respondent No.3.

Issue notice upon respondents No.4 & 5 by registered post with A/D.

Processes to be submitted within 7(seven) days.

List this matter thereafter when the service is complete on 06.03.2026.

Meanwhile, the respondents are directed to submit counter- affidavit, if any.
