Learned Senior Counsel, Mr. Bibhal Nandi Majumder assisted

by Learned Counsel, Mr. Samrat Sarkar is present on behalf of the

accused-petitioner.

Learned Dy. SGI, Mr. Bidyut Majumder appeared and

submitted that since this is a case relating to Customs Department, this

case will be conducted by Learned Counsel, Mr. Biplabendu Roy. So,

Learned Dy. SGI urged for deleting his name from this case.

Request is considered.

Learned Counsel, Mr. Biplabendu Roy appeared on behalf of the

respondent and sought for a short adjournment to submit affidavit in

opposition against the application filed by the accused-petitioner.

This matter was posted on 02.02.2026. But, on that day

none appeared on behalf of the respondents. The accused-petitioner is

languishing in jail for a considerable period of time. Learned Senior

Counsel, Mr. Majumder at this stage, urged for releasing the accused-

petitioner on bail in any condition or at least to grant him interim bail.

However, considering the gravity and nature of the offence,

at this stage, I am not inclined to consider this matter till filing of the

objection.

Accordingly, the case is adjourned today.

Further, Learned Counsel for the respondent shall produce

the case diary on the next date.

List the matter on 12.02.2026. The respondents shall

invariably file their reply on or before the next date failing which, this

Court shall proceed in accordance with law to dispose of the matter.
