HON'BLE JUSTICE DR. T. AMARNATH GOUD _O_ R_ D_ E_ R_ 11.07.2025 When the case is called, both sides present. Learned senior counsel appearing for the petitioner has submitted before this Court that this writ petition is filed for implementing the orders passed by this Court in WP(C) No. 257 of 2016 dated 27.09.2016 and the same in the writ appeal which was not interfered with insofar as Para-6 regarding payment of Rs.40,51,439/-. Later on, a review petition was filed by the petitioner herein which was stood dismissed in June, 2023 by the Hob'ble Division Bench of this Court.

In view of above legal journey, the present petition is now before this Court seeking to implement the order passed in the writ order with regard to the payment of Rs. 40,51,439/-to be paid by the respondents to the petitioner.

This Court raised a question before the learned senior counsel as to why contempt case was not filed for compliance of the Court's order thereafter, learned senior counsel in all fairness has submitted that they did not choose to file contempt but the present writ petition is filed. This Court further questioned to the learned senior counsel with regard to the maintainability of the second writ to implement the order passed in the first writ petition after prolonged period of so many years. At this juncture, learned senior counsel seeks an accommodation to place judgments of the Hon'ble Apex Court on the point of maintainability of the second writ.
