[1] When the case is called, Ms. Saswati Nag, learned counsel appears

on behalf of the applicant. Mr. R. Saha, learned Addl. P.P. appears on behalf of

the State.

[2] This is an application filed by the applicant under section 389 of Cr.

P.C. for suspending the impugned Judgment and order of conviction and sentence

dated 03.09.2024 passed by the learned Additional Sessions Judge, Bishalgarh,

Sepahijala District, Tripura, in Case No. ST (T-1) 07 of 2018 whereby the convict

appellant namely, Parul Barman, have been convicted for the offences punishable

Under Sections 302 of the Indian Penal Code (IPC), and sentenced to suffer

Rigorous Imprisonment for life and also to pay a fine of Rs 50,000/-(Rupees fifty

thousand) only and in default of payment, to suffer R.I. for further one year.

[3] Ms. S. Nag, learned counsel for the appellant-applicant insisted that

applicant herein seeking suspension of the impugned order is a 63 year old ailing

lady. According to her, from the deposition of the witness, i.e. P.W. 4, P.W.5,

P.W.6, P.W.8, P.W. 9 & P.W. 13 all being neighbours of the deceased, it is clear

that that the deceased and her mother -in-law had a very good and cordial

relationship.

[4] During the course of argument, this Court instructed the learned

counsel for the applicant to place the dying declaration and also the inquest report

on record. In all fairness, learned counsel has placed before us the dying

declaration for perusal which is in Bengali version. One of us, Justice B. Palit has

perused the same and it is read over that the mother-in-law i.e. the applicant

herein has tied the cloth around her face and thereafter poured kerosene and set

her ablaze.

[5] In view of the said dying declaration, this Court is not inclined to

grant any relief of suspension of the impugned Judgment and order of conviction

and sentence dated 03.09.2024 in this present IA.

[6] Accordingly, the instant IA stands dismissed.
