Heard Learned Counsel, Mr. Manojit Saha appearing on

behalf of the appellant-applicant and also heard Learned P.P., Mr.

Raju Datta appearing on behalf of the respondent-State.

The appellant-applicant has preferred an appeal under

Section 374(2) of Cr.P.C. challenging the judgment and order of

conviction and sentence dated 20.06.2025 delivered by Learned

Sessions Judge, North Tripura, Dharmanagar in connection with

case No.S.T.(Type-2)/32/2021. By the said judgment and order of

conviction and sentence, Learned Sessions Judge has found the

appellant-applicant to be guilty under Section 498A of IPC and

sentenced him to suffer RI for two years and also to pay a fine of

Rs.5,000/- i.d. to suffer imprisonment for further three months.

Along with the memo of appeal, another application under Section

389 of Cr.P.C read with Section 374(2) of Cr.P.C. is filed by the

appellant-applicant for suspending the judgment and order of

conviction & sentence.

This Court has already admitted the appeal.

So, the sentence imposed by Learned Sessions Judge

be suspended till disposal of this appeal subject to execution of

bond of Rs. 30,000/- with one surety of like amount to the

satisfaction of Learned Trial Court.

With this observation, the present Interlocutory

application stands disposed of.

A copy of this order be supplied to Learned Counsel for

the appellant-applicant. Also, a copy of this order be

communicated to Learned Sessions Judge, North Tripura,

Dharmanagar.
