Heard Mr. Samarjit Bhattacharjee, learned counsel
appearing for the petitioners and Mr. Asish Nandi, learned counsel
appearing for the respondents-ONGC.
Both the learned counsel submits that the petitioners need
to rely on a judgment passed by the Gujarat High Court, which is now
under challenge before the Hon'ble Supreme Court, and the Hon'ble
Supreme Court has granted stay regarding the operation of said
judgment.
Mr. Bhattacharjee, learned counsel further submits that the
issues involved in the said writ petition are identical in nature.
Both the learned counsel agreed that the decision of the
Hon'ble Supreme Court will have bearing in the decision of this Court,
and therefore, the Court may wait for the decision of the Hon'ble
Supreme Court in this regard.
Considered the submission.
Let the matter appear on 01.07.2025.
However, prior to the said date if the said case is disposed
of by the Hon'ble Supreme Court, liberty is given to the parties to
approach the Court prior to that date.
