Heard learned counsel for the respective parties.

This application has been filed under Section 173(1) Proviso of

the Motor Vehicles Act, read with Section 5 of the Limitation Act for

condoning the delay of 11 days in preferring the appeal against the

impugned judgment and award dated 06.09.2024, passed by the Member,

Motor Accident Claims Tribunal North Tripura, Dharmanagar in T.S. (MAC)

NO. 45 of 2021.

For the reason stated in the accompanying affidavit and the

averments made out before this Court during the course of arguments,

delay caused in preferring the appeal is condoned and the same is ordered.

In view of the same, this instant interlocutory application is

allowed and thus disposed of.
