Order 26/09/2024 Learned counsel Mr. R. Saha is present for the appellant-

applicant.

Mr. R. Chakraborty, Learned counsel is present for the

respondents No.1-4 is also present.

The appellant-applicant has preferred this appeal challenging

the judgment and award dated 24.04.2023 passed by Learned Motor

Accident Claims Tribunal No.1, Sepahijala District, Sonamura in

connection with Case No.T.S.(MAC) 19 of 2021 and along with memo

of appeal another application is filed under Section 5 of the

Limitation Act for condoning the delay of 343(three hundred forty

three) days in preferring the appeal.

Learned Counsel for the appellant submitted that inspite of due

diligence, the appellant could not find the proper address of

respondent No.5 and further submitted that at this stage the

presence of said respondent is not required for issue notice.

Learned Counsel for the claimant-respondents submitted to

allow the said respondents No.1-4 to file objection.

The case is adjourned.
