These contempt petitions have been preferred alleging non-
compliance of the judgment and order dated 20.05.2022 passed by the learned
Writ Court in WP(C) No.901 of 2021 and analogous cases by which the
learned Court directed the respondents to give the benefit of past service to the
petitioners.
Aggrieved thereby, the appellant-State of Tripura approached this
Court in W.A. No.304 of 2021 and other analogous appeals. Those appeals
have been heard and decided by the judgment and order dated 09.01.2024
whereby this Court directed the competent authority under the department to
scrutinize the case of the individual writ petitioners in the light of the principles
laid down thereinabove and take a decision within a period of 3(three) months
from the date of receipt of copy of the judgment. It was further observed that
consequential benefits, if any, arising out of such decision shall flow in favour
of the individual writ petitioners who satisfy the conditions prescribed
thereinabove.
Since the order of the learned Writ Court has been modified by the
learned appellate Court as above, the present contempt petitions do not survive.
As such, Mr. P. Roy Barman, learned senior counsel assisted by Mr. Kawsik
Nath, learned counsel appearing for the petitioners also submits that since the
learned appellate Court has issued certain directions in relation to granting of
past service benefits to the petitioners, the present contempt petitions could not
be maintained further.
Learned counsel for the State also submits to that effect.
In view of the aforesaid reasons, the instant proceedings are
dropped and accordingly, the contempt petitions are disposed of.
