The application under Section 47 of the Civil Procedure Code filed

by the judgment-debtor/petitioner herein has been rejected by the impugned

order dated 09.04.2024. Petitioner has questioned the jurisdiction of the Trial

Court in passing the decree and judgment as the subject matter of the case was

falling under the Commercial Courts Act, 2015. He submits that the question of

jurisdiction goes to the root of the matter. Certain judgments were also relied

upon by him before the learned Court, but the prayer has been rejected.

Issue notice on the plaintiff decree holder/respondent under

ordinary process and Speed Post for which requisites be filed by 16.07.2024.

Notice is made returnable on 16.08.2024.
