Heard learned counsel for the appellant-Bank.

The appeal is directed against the judgment dated 03.03.2023

in WP(C) No.121 of 2023 inter alia directing the respondents to consider

the representation of the petitioner dated 12.12.2022 for reconsidering his

transfer order dated 02.12.2022 within a period of 2(two) months from the

date of receipt of copy of this order.

The appeal suffers from a delay of 22 days for condonation of

which IA No.01 of 2023 has been preferred. However, after hearing

learned counsel for the appellant both on the delay condonation petition

and on merits of the appeal, we are not inclined to entertain this appeal as

the learned Writ Court has simply directed the respondents/appellants

herein to decide the representation of the petitioner for reconsideration of

his transfer order dated 02.12.2022. Obviously, no comments on merits of

the case of the petitioner have been made by the learned Writ Court in such

circumstances.

Learned counsel for the appellant-Bank seeks extension of

time for deciding the representation as the 2(two) months period may have

been over by now.

We agree to the prayer.

Time for taking a decision on the representation of the

petitioner stands extended by another 15(fifteen) days from today.

However, for the aforesaid reasons, the appeal is dismissed without any

interference.

The application stands disposed of. Pending application(s), if

any, also stands disposed of.
