HON'BLE MR. JUSTICE T. AMARNATH GOUD HON'BLE MR.JUSTICE ARINDAM LODH 04.05.2023 Order Mr. S. Majumder, learned counsel appearing for the appellant requests for an adjournment today on the ground that learned conducting senior counsel Mr. Somik Deb will argue the case. It is also contended by Mr. Majumder, learned counsel that the appellant was terminated from service because of unauthorized absence and the punishment imposed is disproportionate.
Mr. Majumder, learned Dy.SGI appearing for the respondents submits that the appellant is a defence personnel and unauthorized absence in the defence service is a serious offence and accordingly, inquiry was conducted for his misconduct and under Rule 22 of Border Security Force Rules,1969 his service has been terminated following the due procedure.
Mr. Majumder, learned Dy.SGI pleads to upheld the judgment of the learned Single Judge as there are no infirmities in the order for giving an opportunity to the appellant to submit his reply.
Prayer stands allowed.
