HON'BLE MR.JUSTICE ARINDAM LODH 10.03.2023 Order Heard Mr. D. Bhattacharya, learned G.A. assisted by Mr. S. Saha, learned counsel appearing for the State-applicants. Also heard Ms. R. Purakayastha, learned counsel appearing for the respondent, i.e. the original writ petitioner.
Mr. D. Bhattacharya, learned G.A. has submitted that the State-applicant has filed the instant application to keep the judgment and order dated 14.11.2022, passed in WP(C) No.917/2022, in abeyance.
Ms. Purkayastha, learned counsel appearing for the original writ petitioner has submitted that the State-applicants by issuing Memorandum dated 20.02.2023, put the petitioner, Sri Soumitra Chakma again under suspension. It is pertinent to mention herein that the original suspension order passed upon the petitioner has already been set aside by this court.
In view of this, the Memorandum dated 20.02.2023 amounts to willful disobedience of the court's order. However, Mr. Bhattacharya, learned G.A. has submitted that the court should take a lenient view against the applicant-contemnors and he will take necessary steps so that the
petitioner Sri Soumitra Chakma can join his service on Monday i.e. 13.03.2023.
The instant I.A. stands dismissed in the light of the above order.
