Heard Mr. K. Nath, learned counsel appearing for the petitioner. Also heard Mr. D. Bhattacharya, learned GA assisted by Mr. S. Saha, learned counsel appearing for the respondents-State.

Mr. Nath, learned counsel has submitted that the present case is fully covered by the judgment of this Court.

However, Mr. Bhattacharya, learned GA has submitted that in the instant case the State needs to file counter affidavit and for this purpose he has sought for 4(four) weeks time.

The State-respondents are given liberty to file counter affidavit within 4(four) weeks.

List the matter on 13.02.2023. An endeavour shall be taken to dispose of the matter at the admission stage itself.
