                                                    ORDER

In pursuant to the order dated 22.08.2023, Sri Sanjit Kumar Dey, the

petitioner and Sri Haradhan Bir, the complainant have appeared before this court and

their presence is accordingly dispensed with. Both parties have settled the matter

amicably and both agreed for the following.

The defaulter namely Sanjit Kumar Dey, (the petitioner herein) has

undertaken to pay an amount of Rs.80,000/- towards the full and final settlement as

against the cheque amount of Rs.75,000/- which was decreed in favour of the

complainant @ Rs.90,000/-.

The petitioner herein has undertaken to pay Rs.80,000/- in two equal

installments (Rs.40,000/-each). The first installment shall be paid on or before

30.09.2023 and the second installment shall be paid on or before 30.11.2023.

It is further volunteered and indicated by Sri Sanjit Kumar Dey (the

petitioner herein) that in the event if he does not pay the amount as agreed on or

before 30.11.2023, he is ready to face the consequences as directed against him by

the order dated 29.08.2022 passed by the court below in Criminal Appeal No.05 of

2020 in letter and spirit. The complainant, Sri Haradhan Bir, is present before this

court today and he has no objection to such agreement.

It is needless to observe that once the entire payment is made as agreed

by the petitioner herein by way of a proper acknowledgment, the Judgment and Order

dated 29.08.2022 which is under challenge will automatically stand set aside.

With the above condition as agreed upon by the petitioner herein, the

present criminal revision petition stands disposed of.
