The respondents have not been able to obtain any interim stay of
the order dated 12.12.2022 passed by this Court in W.A. No.153 of 2022 by
which this Court refused to interfere with the judgment and order passed by the
learned Single Judge. The respondents were directed to complete the entire
process of regularization of the petitioners within a period of 3(three) months
from the date of receipt of the copy of the order. The contempt petition has
been filed after expiry of the period stipulated by this Court. The order sheet of
the case shows that the notices were issued upon the respondents No.1 to 3 on
20.04.2023. The respondents appeared on the next date, i.e. on 18.05.2023. It
was submitted on behalf of the respondents that the State has gone in SLP
before the Apex Court bearing Diary No.20762 of 2023. As such, the matter
was adjourned for 4(four) weeks so that appropriate orders could be produced
on the next date. The matter was taken on 13.07.2023 thereafter. However,
learned counsel for the respondents submitted that the case was at the level of
defects and steps were being taken for removal of the defects for being listed it
before the Bench.
After hearing learned counsel for the parties, the matter was
adjourned for today, i.e. after six weeks giving them opportunity to obtain
interim order or to comply with the order. Today, neither the respondents have
been able to obtain an interim order nor they have complied with the order.
They have also not made any application for extension of time to comply the
order. It appears that the respondents are not serious about compliance of the
order or pursuing the Special Leave Petition before the Apex Court. In such
circumstances, this Court is constrained to grant two weeks' further time to
comply with the order or else obtain an interim order in their favour, otherwise
this Court may be compelled to summon the respondents No.1 and 2 on the
next date.
The matter be listed on 12.09.2023.
