_O_ R_ D_ E_ R_ 17/04/2023 Husband is aggrieved by maintenance awarded @ Rs.6,000/-

per month vide impugned judgment dated 14th September, 2022 passed

by the learned Family Court, Kailashahar, Unakoti Tripura in Criminal

Misc.(125) -75 of 2021. The revision petition suffers from a delay of 37

days for condonation of which IA No.01 of 2023 has been preferred.

Issue notice on the respondents under registered post with

A/D for which requisites be filed within one week.

Notice is made returnable within 4(four) weeks.

The respondent No.1 is the wife of the petitioner while

respondents No.2 and 3 are minor children. The respondent No.1 being a

lady and respondents No.2 and 3 being minor are entitled to legal aid as

covered under the definition of Section 12(c) of the Legal Services

Authorities Act, 1987. Considering the status of the respondents and the

fact that they are actually pursuing a maintenance case that means are in

need of maintenance to survive, it would be proper to enquire from them

whether they need legal aid. As such, the Member Secretary, High Court

Legal Services Committee shall make inquires through the Secretary,

District Legal Services Authority (DLSA), Unakoti Tripura whether the

respondents are in need of legal aid. Such inquiries can be made through

Para Legal Volunteers. Let the necessary details of the respondents

together with the case number of the court below and their address be

indicated in the communication by the Registry to the Member Secretary,

High Court Legal Services Committee for effective compliance. On such

inquiries if the respondents make an application for legal aid, the same be

processed, in accordance with law.

Let the matter appear along with the report of the Secretary,

District Legal Services Authority (DLSA), Unakoti Tripura on 10th May,

2023.
