Heard Mr. C.S. Sinha, learned counsel appearing for the petitioner. Mr. Sinha, learned counsel has submitted that by the order dated 08.01.2021 delivered in WP(C)No.240 of 2016, this court has directed the respondent for indentifying the post for reservation under the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 or under the Rights of Persons with Disabilities Act, 2016 within a period of six months from the date of judgment. The petitioner had sent a demand notice on 30.12.2021 when it has been noticed that no appropriate action has been taken. It appears from the records that on 07.09.2021, the Department of Social Welfare and Social Education has adopted the guidelines for effecting reservation for the persons with Benchmark disabilities.
The grievance of the petitioner is that by the said guidelines, no promotional post has been identified. This cannot be a subject matter of a contempt proceeding. If the petitioner is aggrieved by the said guidelines, the petitioner should come out with a new writ petition challenging the constitutionality of the said guidelines.
Having observed thus, this petition stands dismissed. No order as to costs.
