HON'BLE MR. JUSTICE ARINDAM LODH Order 05/07/2022 In the order dated 30.06.2022, it reveals that this court due to inadvertence written "Appeal is admitted". However, it should be "This Revision Petition is admitted". Accordingly, the order dated 30.06.2022 is corrected in the manner as under:

"This Criminal Revision Petition is admitted to be heard" instead of "Appeal is admitted to be heard".

This application is filed by the applicant for suspending the sentence of imprisonment dated 31.05.2022 passed by the learned Additional Sessions Judge, Gomati Judicial District, Udaipur in case no. Criminal Appeal 12 of 2021 modifying and upholding the judgment dated 29.09.2021 passed by the learned Judicial Magistrate, Court no.3, Gomati, Tripura in case no. PRC (SP) 12 of 2020.

Heard Mr. K. Deb, learned counsel for the applicant. Also heard Mr. R. Datta, learned PP appearing for the respondent-State.

Mr. Deb, learned counsel for the applicant has submitted that the applicant is on bail and he has never misused the privilege of bail during trial, before the trial court as well as the appellate court.

Considering the period of imprisonment, I am inclined to suspend the order of sentence dated 31.05.2022 passed by the learned Additional Sessions Judge, Gomati Judicial District, Udaipur in case no. Criminal Appeal 12 of 2021 till disposal of the instant criminal revision petition.

Accordingly, the applicant, namely, Goutam Das, is allowed to remain on bail on furnishing a bail bond of Rs. 25,000/- supported by one surety of the like amount to the satisfaction of the Judicial Magistrate 1st Class, Court No. 3, Gomati, Tripura.

The interlocutory application for suspending the sentence, as stated above, is accordingly disposed of.
