Heard Mr. R Datta, learned counsel appearing for the petitioner.
This is a petition for drawing up a contempt proceeding against
the respondents for deliberately violating the interim direction dated
29.11.2021 delivered in WP(C) No.854 of 2021.
Issue notice calling upon the respondents to show cause as to
why a contempt proceeding under Section 12 of the Contempt of Courts Act,
1971 read with Article 215 of the Constitution of India shall not be drawn up
against the respondents for deliberately violating the directions as contained in
the judgment and order dated 29.11.2021 delivered in W.P.(C) 854 of 2021,
as prayed for; and/or any other order(s) shall not be passed as to this Court
may deem fit and proper in the circumstances of the case.
The notice is made returnable on 04.02.2022.
Steps for service, in accordance with the rules, be taken by the
petitioner within 3 (thee) days from today by registered post with A/D.
It is made absolutely clear that if by the returnable date, no reply
is filed by the respondents, this court may be compelled to ask for personal
appearance for explaining their conduct.
