Heard Ms. R Purkayastha, learned counsel appearing for the
applicant.
This is an application under Section 5 of the Limitation Act, 1963,
for condoning the delay of 254 days, though initially the applicant has
calculated the delay at 914 days, in filing the appeal against the
judgment and decree respectively dated 11.06.2019 and 14.06.2019,
as delivered in T.S.(Div) No.05/2018 by the Judge, Family Court,
Agartala, West Tripura.
Issue notice calling upon the respondent to show cause as to why
the delay of 254 days in preferring the connected appeal shall not be
condoned, as prayed for; and/or why such further and other order(s)
shall not be passed.
The notice is made returnable on 19.05.2022.
The applicant shall take steps for service notice on the sole
respondent by registered post with A/D within a week from today.
