Heard Mr. P. K. Pal, learned counsel appearing for the
applicant.
This is an application under Section 5 of the Limitation Act
for condoning the delay of 1153 (one thousand one hundred and
fifty three) days. But according to the Stamp Reporter's report
the delay is of 1032 (one thousand and thirty two) days. Be that
as it may, the applicant prays for condonation of such period of
delay for filing an appeal against the judgment and award dated
07.04.2018 delivered in Misc.(L.A.)31 of 2015.
Issue notice calling upon the respondents to show cause as
to why the delay of 1032 (one thousand and thirty two) days in
preferring the connected appeal shall not be condoned as prayed
for; and/or any other order(s) shall not be passed as to this
Court may deem fit and proper in the circumstances of the case.
Notice is made returnable on 29.11.2021.
Since Mr. A. De, learned counsel appears and waives notice
for the respondent No.1 and Mr. M. Debbarma, learned Addl.
G.A. appears and waives notice for the respondent No.2, no
formal notice needs be issued.
The respondents those who are inclined to file the objection
they may file such objection in the meanwhile.
