Order
20/07/2021 Heard Mr. T. Debbarma, learned counsel appearing for the
petitioner.
This is a petition under Section 12 of the Contempt of
Courts Act, 1971 read with Article 215 of the Constitution of
India for drawing up the contempt proceeding against the
respondents for their wilful disobedience to the order dated
16.04.2021 passed in W.P.(C) 404 of 2020 titled as Onkar
Sadhan Adhikari vs. Tripura University and Ors whereby
this court has directed to release the pension and other retiral
benefits of the petitioner within two months from the day of the
judgment. But a condition has been attached in the event of
non-payment, that the due amount shall carry interest @7%
per annum from the date when the amount fell due till the
amount is paid.
Be that as it may, since this amount has not been paid the
petitioner has approached this court for drawing up a contempt
proceeding.
Issue notice calling upon the respondents to show cause
as to why a contempt proceeding under Section 12 of the
Contempt of Courts Act, 1971 read with Article 215 of the
Constitution of India should not be drawn up for violation of the
order dated 16.04.2021 passed in W.P.(C) 404 of 2020 as
prayed for; and/or any other order(s) shall not be passed as to
this Court may deem fit and proper in the circumstances of the
case.
Notice is made returnable on 27.08.2021.
Steps as per rule for service of notice on the respondents
shall be taken by the petitioner within a week from today by
registered post with A.D.
