Mr. D. Bhattacharjee, learned GA appearing for the

respondents has submitted that against the judgment and order of a

Division Bench dated 22.12.2020 delivered in WA.192 of 2020, the

respondents have proposed to file a Special Leave Petition (civil) in

the Supreme Court.

Hence, the respondents pray for some more time.

The prayer stands allowed.

List the matter on 03.03.2021. On that day, Mr. D.

Bhattacharjee, learned GA shall apprise this court of the status of

SLP(C), if filed any.

It appears from the reply filed by the respondent No.3

that he was never posted as Divisional Forest Officer (DFO), West

Tripura during his entire service career but he has been impleaded as

the respondent No.3.

Having confronted with the such revelation, this court is

of the view that the proceeding against the respondent No.3 be

recalled by striking off his name from the array of respondents.

Accordingly, it is ordered.

Notice issued on the respondent No.3 is recalled. So far

the proceeding in respect of him is concerned stands closed.

Mr. Bhattcharjee, GA has produced the affidavits filed by

the respondents in the court. Those are taken into records. Entries

shall be made in the records in this regard.
