Heard Mr. C.S. Sinha, learned counsel appearing for the petitioner as well as Mr. D. Bhattacharya, learned counsel appearing for the respondent.
The respondents have filed today their reply. The reply is taken in the records. Registry shall make the necessary endorsement.
Mr. C.S. Sinha, learned counsel appearing for the petitioner has strenuously argued the directions contained in Para-6 of the judgment and order dated 29.07.2019 delivered in WP(C)No.40 of 2019 titled as Sri Usha Jen Mog versus State of Tripura and Others have been flouted by the respondents.
This court has given an anxious consideration. From a bare reading of the said Para-6, it appears that the court had directed that all the directions given in Para-6 shall be complied by the respondents within a period of two months from the date of order of the apex court, unless is otherwise directed.
The outcome of the apex court proceeding is still awaited. As such, this petition for drawing up contempt proceeding is premature and hence, the same stands closed. However, this will not take away the right of the petitioner to approach this court again.
The notice that was issued stands recalled. Mr. D. Bhattacharya, learned counsel for the respondents gathers accordingly.
