ORDER
25/02/2021 The petitioner has crossed the age of superannuation in the
month of 30th June, 2014. However, on account of pending criminal case
and thereafter continuation of departmental inquiry post retirement, he has
not received any monetary benefits since several years.
Counsel for the petitioner submitted that after his acquittal by
the High Court by a judgment dated 02.05.2019, his dismissal which was
based on his conviction by the trial Court has been recalled, however even
provisional pension has not been paid to him.
Issue notice to the respondents, returnable for 25th March,
2021.
Mr. Mangal Debbarma, learned Additional Government
Advocate waived notice on behalf of respondents No.1, 2 & 3 and Mr.
Bidyut Majumder, learned Assistant Solicitor General waived notice on
behalf of respondents No.4 and 5.
