Rule.

Learned counsel Mr. I Chakraborty waived Rule on behalf of the

respondent.

This application is filed by the appellant Food Corporation of

India(FCI) to produce additional evidence in the form of a certified copy

of an agreement dated 15th September, 2009. It is stated that only a copy

of this agreement was produced before the trial Court and, therefore, the

agreement was not exhibited. However, learned counsel for the applicant

pointed out that in civil suit No.TS 15/2012 out of a judgment of which

connected RFA No.3/2016 is arising between the same parties, the said

agreement in original was produced and duly exhibited. In that view of the Page - 2 of 2

matter, there should be no harm in allowing the applicant to bring on

record certified copy of the said agreement by way of additional evidence.

Application is allowed.

Interlocutory application is disposed of.
