Heard Ms. R. Chakraborty, learned counsel appearing for the petitioner.
This is a petition under Section 12 of the Contempt of Courts Act, 1971
read with Article 215 of the Constitution of India for initiating a contempt proceeding
for showing willful and deliberate disobedience to the direction contained in the
judgment and order dated 01.12.2020 delivered in WP(C)No.1329 of 2017
[Annexure-1 to this petition].
Ms. Chakraborty, learned counsel has submitted that despite the
judgment is presented in due time but the said direction has not been complied by
the respondent.
Issue notice calling upon the respondents to show cause as to why a
contempt proceeding under Section 12 of the Contempt of Courts Act, 1971 read
with Article 215 of the Constitution of India should not be drawn for purported
violation of the order dated 01.12.2020 delivered in WP(C)No.1329 of 2017 as
prayed for; and/or any other order(s) shall not be passed as to this Court may deem
fit and proper in the circumstances of the case.
Notice is made returnable on 04.10.2021.
Steps for service of notice in accordance with the rule shall be taken by
the petitioner within a week from today by registered post with AD.
It is made absolutely clear that if the reply explaining the reason for
non-compliance is not filed by the respondent by the returnable date, this court may
direct physical appearance of the respondent for explaining their above conduct.
